Terms of Service

These Terms govern your access to and use of FieldMark — the fieldmark.work website, our mobile apps, and the FieldMark service (the “Service”). By creating an account or using the Service, you agree to these Terms. If you’re using FieldMark on behalf of an organization, you’re agreeing on its behalf.

The Service

FieldMark provides project management, logging, estimating, invoicing, payroll, and related tools for construction and service businesses. We may add, change, or remove features over time to improve the Service.

Your account

You’re responsible for your account, for keeping your credentials secure, and for the activity of the people you invite to your organization. Provide accurate information and keep it current. Notify us promptly if you believe your account has been compromised.

Acceptable use

Use the Service lawfully. Don’t misuse it — for example by attempting to breach security, disrupt the Service, reverse-engineer it, resell it without permission, or use it to store or transmit unlawful content. You’re responsible for the data you put into the Service and for having the right to use it.

Your data

Your business data is yours. You grant us the limited rights needed to host, process, back up, sync, and display that data in order to provide the Service to you and the members of your organization. We handle personal information as described in our Privacy Policy.

Billing and subscriptions

Paid plans are billed through our payment processor (Stripe) on the cadence shown at checkout. Fees are charged in advance and are non-refundable except where required by law. You can cancel at any time; cancellation takes effect at the end of the current billing period. Taxes may apply. We may change pricing with reasonable notice.

Third-party services

The Service relies on third-party providers (such as hosting, sync, and payment infrastructure) and may integrate with services you choose to connect. Your use of those services is subject to their own terms.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. FieldMark helps you organize your business records but is not a substitute for professional accounting, tax, or legal advice.

Limitation of liability

To the fullest extent permitted by law, FieldMark and its suppliers will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms or use the Service in a way that creates risk or liability. On termination you may export your data for a reasonable period.

Changes to these Terms

We may update these Terms as the Service evolves. When we make material changes we’ll update the date above and, where appropriate, notify you in the app. Continued use after changes take effect means you accept the updated Terms.
